The Office of the Health Ombudsman is an independent statutory body established to protect and support the community through responsive complaints processes and regulatory action, driving positive change and confidence in the health system.
This role appointed by the Health Ombudsman and is responsible for taking proceedings against registered health practitioners in the Queensland Civil and Administrative Tribunal (QCAT). The role of Director of Proceedings requires the independent exercise of decision making in respect of these matters, with the paramount consideration of protecting public health and safety. As the Director of Proceedings, you are also a member of the Office of the Health Ombudsman’s Executive Leadership Team and work collaboratively to achieve the office’s legislative, strategic, and operational objectives.
In this role, you will play a critical part in maintaining public confidence in the health system by ensuring that disciplinary proceedings are conducted with integrity, transparency, and fairness. Your work will directly reflect the community’s expectations for accountability and high standards in healthcare, reinforcing the Office’s commitment to protecting the public and upholding trust in the regulatory process and health complaints system.
As you will be working closely with the Health Ombudsman, the other Executive Directors and a range of stakeholders, it’s vital that you are a collaborative, flexible and poised professional, with an engaging personality. In this role, you will be responsible for leading and managing a team overseeing all aspects of disciplinary proceedings filed in QCAT, , allocated to internal legal staff or external legal providers. This includes drafting pleadings, presenting evidence, making submissions on sanctions, and progressing cases to final hearings and determinations. The Director may personally appear in proceedings as necessary and needs to be comfortable doing so. Additionally, you will manage the conduct of appeals or judicial review applications related to QCAT disciplinary proceedings. You will also provide strategic and operational leadership for the performance of the ‘Director of Proceedings’ functions, fostering a positive workplace culture and supporting staff to achieve their operational and performance targets.
The successful candidate will demonstrate an awareness of emerging issues in health practitioner regulation, particularly considerations for maintaining public confidence in health practitioners and the health system. A forward-thinking and well-researched approach is essential to ensure the Office remains responsive to evolving community needs and regulatory challenges.
You must be a qualified lawyer, solicitor, or barrister eligible to practice law in Queensland. You should have extensive experience managing complex litigation or prosecutions, particularly those involving sensitive matters and potential risks of harm. You should have a proven track record of practicing in court or tribunal settings and possess detailed knowledge of complaints and regulatory systems. Additionally, you should be well-versed in applying professional standards and codes of conduct within a sensitive and complex regulatory environment.
